This post concludes and recaps my series on the need for San Bernardino, California residents to have an estate plan. I felt it necessary to write on this topic as estate planning is something that many people feel they can put off until a later date. Unfortunately, far too many individuals never get around to completing the process and, as a result, pass away without having a last will and testament. The goal of my last several articles has been to provide information that stresses the need of having a plan in place and for such information to assist in the selection of an attorney. If you have questions or need assistance, then contact my office today to speak with a lawyer.
I have addressed several topics over my recent articles. Issues I have analyzed include:
- The need for San Bernardino residents to have a will
- Using a Trust as part of your estate planning
- The need to keep an estate plan up to date
- The problem with using “self-help” wills
These are important topics for one to understand. First, many err by thinking that their assets will be seized by the state of California, be passed to their children or a specific individual without any court order or legal instrument, upon their death. The truth of the matter is that, under California’s intestate succession laws, a person’s assets may be distributed in a way that is not consistent with their final wishes. Second, using a Trust as part of an estate plan allows for a larger level of flexibility and efficiency that is not possible if one simply uses a last will and testament. Third, by keeping an estate plan up to date you ensure that changes in your personal circumstances do not result in your plan becoming outdated. Finally avoiding self-help forms helps to ensure that that you properly deal with all possibilities.
One point I have stressed through each of these articles is that no two people have the same situation and by speaking with an experienced lawyer your specific circumstances are considered. This can prevent your loved ones from finding themselves in a situation where there is infighting and disagreement because your estate plan was not properly set up. I assist people identify the issues which exist in their situation and set up a plan to deal with those situations. Contact my office today to make an appointment.
